Effective upon purchase or download of any Digital Product from VECTORTWIST.
1. Definitions
The following terms apply throughout this Agreement:
“VECTORTWIST” means Simona Pfreundner, operating as VECTORTWIST, including her successors and authorized distributors.
“Digital Product” means any file or collection of files purchased or downloaded from VECTORTWIST, including but not limited to vector graphics, illustrations, patterns, textures, brushes, templates, scripts, fonts, and any associated documentation or supporting files.
“End Product” means a new, original work created by you that incorporates the Digital Product as a component or element. The Digital Product must be a part of something larger and may not be used as the primary deliverable on its own.
“You” means the individual who purchased the license. This license is non-transferable and applies to one individual only.
2. What You May Do
Subject to the terms of this Agreement, VECTORTWIST grants you a non-exclusive, non-transferable, worldwide license to:
2.1 Personal Use
Use the Digital Product to create End Products for your own personal, non-commercial purposes.
2.2 Commercial Use
Use the Digital Product to create End Products that you sell, license, or distribute commercially, including client work, branded materials, packaging, advertising, and products for sale, provided the Digital Product is incorporated into a new design and is not used on its own.
2.3 Client Work
Use the Digital Product to create End Products on behalf of a client. Your client is bound by this license and may not extract or reuse the Digital Product independently.
2.4 Modification
Modify, adapt, or transform the Digital Product to create derivative works, provided the result is used only as part of an End Product and is not redistributed in modified or original form.
3. What You May Not Do
3.1 No Redistribution
You may not sell, sublicense, share, transfer, gift, or otherwise distribute the Digital Product on its own, in any form, whether modified or unmodified, free of charge or for a fee. This includes sharing via shared drives, asset management platforms, team libraries, or any system accessible to individuals not covered by this license.
3.2 No Resale of Raw Assets
You may not sell or offer for sale the Digital Product itself, packaged with other assets, bundled into a kit, or presented as a template, stock item, or downloadable resource.
3.3 No Standalone Display
You may not publicly display the Digital Product as a standalone file online or make it downloadable by third parties in its original or only-minimally-modified form.
3.4 No Trademark Registration
You may not register any Digital Product or End Product incorporating a Digital Product as a trademark or logo mark, as the underlying asset remains available to all licensees.
3.5 No Misrepresentation
You may not claim authorship of the Digital Product or represent it as your original creation. Credit to VECTORTWIST is not required in end products but misrepresentation of origin is prohibited.
3.6 No Reverse Engineering of Scripts
For Digital Products that are functional tools, scripts, or code-based files, you may not decompile, reverse engineer, disassemble, or otherwise attempt to extract or reconstruct the underlying logic or source beyond what is necessary to use the tool as intended.
4. Artificial Intelligence
4.1 No AI Training Use
You may not use any Digital Product, in whole or in part, as training data, fine-tuning data, reference data, or input data for any artificial intelligence system, machine learning model, image generation model, or similar automated system.
4.2 No AI-Assisted Redistribution
You may not use AI tools to generate, reconstruct, approximate, or derive versions of the Digital Product for the purpose of redistribution or resale, whether the AI output is identical or substantially similar to the original.
4.3 AI-Assisted End Products Permitted
You may use AI tools as part of your personal creative workflow when producing an End Product that incorporates the Digital Product, provided the Digital Product itself is not submitted to any external AI model or service as input.
5. Scripts and Functional Tools
Where a Digital Product is a script, plugin, action, or other functional tool:
- You may use the script in your personal or commercial workflow to produce End Products.
- You may use End Products created with the script for commercial purposes, including client deliverables and items for sale.
- You may not redistribute, sell, bundle, or share the script file itself under any circumstances.
- You may not use the script to build or power a tool, service, or automated system made available to other users, whether free or paid.
6. Intellectual Property
All right, title, and interest in and to the Digital Products, including all copyright, design rights, and associated intellectual property, remain exclusively with VECTORTWIST. This license grants you usage rights only. No ownership is transferred.
7. License Scope
This license applies to one individual. It is not transferable to another person, team, or organization. If multiple people require access to the Digital Product, each must purchase their own license.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VECTORTWIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE DIGITAL PRODUCTS, EVEN IF VECTORTWIST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
VECTORTWIST’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE DIGITAL PRODUCT IN QUESTION.
9. Governing Law
This Agreement is governed by the laws of Canada, without regard to conflict of law principles. Any disputes arising under this Agreement shall be resolved in the courts of Canada.
10. Acceptance
By purchasing, downloading, or using any Digital Product from VECTORTWIST, you agree to be bound by the terms of this Agreement. If you do not agree, do not download or use the Digital Product.
